Frame's dog, a boxer-pit bull mix taken to Rogers Animal Shelter
BENTONVILLE - A Rogers man must return to the scene of his crime.
Joshua David Frame pleaded guilty Monday to breaking or entering, a class D felony. His plea was under an agreement that attorney Ed McClure reached with Deputy Prosecutor Brandon Carter.
Frame's dog - a boxer-pit bull mix - was picked up Jan. 18 and taken to the Rogers Animal Shelter.
Frame went to the animal shelter later that night and broke in and took his pet. Frame said he cut a lock and escaped with the dog.
Carter said the dog had been left at the shelter long enough to be adopted out.
The deputy prosecutor said Frame used bolt cutters to cut three locks to get to the dog.
A microchip was implanted in the dog, and police were able to track the animal to Frame's residence. Police officers saw the dog in the yard of the residence, and bolt cutters were leaning against the wall when the front door was opened, Carter said.
"Is it a good dog ? "Circuit Judge Tom Keith asked Frame.
"Yes," Frame replied.
Frame said alcohol had influenced his actions.
The judge accepted Frame's guilty plea and the plea agreement.
Frame was placed on three years' state-supervised probation with Act 346, which means his conviction may be expunged if he successfully completes his probation.
Frame must return to the animal shelter, where he will perform 120 hours of community service in the next six months.
He must also pay $ 1, 420 in court-associated costs.
Police did not re-impound the dog after Frame's arrest.
